Welcome to Gabeer ("the Platform", "we", or "us"). Gabeer is a Software-as-a-Service (SaaS) platform that enables businesses to manage customer communication through Meta's official WhatsApp Business Platform. It is operated by the sole proprietor Abdelgelil Ismail.

By using the Platform or subscribing to any of its plans, you acknowledge that you have read and agreed to these Terms & Conditions in full. If you do not agree, please do not use the Platform.

1. Service Description

Gabeer provides subscription-based access to WhatsApp Business communication tools, including: broadcasts and campaigns, a shared team inbox, chatbots and automation, catalogs and forms, analytics, and integrations with other systems. The service is provided on top of Meta's official WhatsApp Business Platform.

2. Messaging Fees and Subscription

Your subscription covers access to the Platform and its tools only. Outbound messaging fees are charged by Meta directly according to Meta's official rates and are paid to Meta directly through your own account. Gabeer does not add any markup or margin on top of Meta's fees.

3. Payment Processing — Merchant of Record

All payments are processed by Paddle.com as our Merchant of Record and authorized reseller of our digital products. Paddle handles billing, payment, and applicable taxes on our behalf, and your purchases are also subject to Paddle's Buyer Terms.

4. Eligibility and Acceptable Use

You must be a business or an authorized representative of one, and must comply with the WhatsApp Business Policy and Meta Commerce Policy. You agree to:

• Obtain explicit opt-in consent from recipients before messaging them.
• Not send spam, unsolicited, or abusive messages.
• Not use the Platform for any unlawful purpose or in violation of WhatsApp/Meta policies.
• Take full responsibility for the content of your messages and your contact lists.

We reserve the right to suspend or terminate any account that violates these Terms or WhatsApp/Meta policies.

5. Subscription, Billing and Cancellation

Subscriptions renew automatically until cancelled. You may pay monthly, quarterly, semi-annually, or annually. You may cancel at any time to stop future renewals; your subscription remains active until the end of the paid period. For refund details, please see our Refund Policy.

6. Intellectual Property

All rights to the Platform, its brand, and its content remain owned by us. Your subscription does not grant you any right to copy, resell, or create derivative works from the Platform.

7. Disclaimers and Limitation of Liability

The service is provided "as is". We do not warrant that the service will be uninterrupted or error-free, and we are not liable for any indirect or consequential damages. We are also not responsible for Meta's or WhatsApp's decisions regarding your account, numbers, or templates.

8. Termination

Either party may terminate this agreement. Upon termination, your access to the Platform ends at the close of the paid subscription period.

9. Governing Law

These Terms are governed by the laws of the Arab Republic of Egypt, unless applicable law provides otherwise. (Please consult your legal advisor to determine the appropriate jurisdiction.)
